Sample Development Policy — GAT Fashion Lab

Official GAT Fashion Lab policy for sample development: scope, timelines, payments, credits, revisions, returns and intellectual property.

01. Introduction and Purpose

This Sample Development Policy establishes the guidelines between GRUPO ARANGO TESSONE SAS - GAT FASHION LAB and its clients with respect to the product development or prototyping service: from the selection of raw materials (fabrics and trims) and artwork approval through delivery of the physical sample. Its purpose is to define:

  1. what is included in the service,
  2. the approval workflow,
  3. the circumstances that give rise to additional charges, and
  4. the conditions for returns or credits.

This policy forms an integral part of the GAT FASHION LAB Terms and Conditions. Acceptance of the quotation and/or payment of the invoice constitutes full acceptance of this policy.

02. Scope and Definitions

For the purposes of this policy, the following definitions apply:

  • Digital Sample: A digital representation generated by software or AI that simulates the garment's design, materials, and proportions, used for validation before sewing.
  • Physical Sample: A garment made with the final materials and processes (or equivalents) to validate patterns, fit, quality, and design before volume production.
  • Process Sample: A physical test of an embellishment process (screen printing, sublimation, embroidery, DTF, high density, etc.) performed on a fabric remnant before applying it to the final physical sample, in order to validate technique, color, placement, and quality in accordance with the Process Sheet.
  • Counter-Sample: A sample produced by GAT FASHION LAB from existing patterns, tech packs, or samples, in order to replicate and/or adjust the design within its processes.
  • Physical Swatch: A physical sample of the selected fabric or trim, sent to the client for validation before purchasing the yardage or unit.
  • Approval: Written communication (email, WhatsApp, or another official channel designated by GAT FASHION LAB) whereby the client approves the fabrics, trims, colors, processes, sizes, adjustments, and in general any proposal made by GAT FASHION LAB for a specific reference — based on photographs, videos, design sheets, process sheets, the Physical Sample, and in general any form of communication. Approval of the physical swatch of fabrics or trims (see Section 4.1) is the first of several approvals in the process: the selection of branding trims (Section 4.2), the Design Sheet (Section 4.4), the process tests (Section 4.6), and the final physical sample (Sections 4.7 and 4.8) each require their own written approval at a different point in the development.
  • Design Sheet: A document prepared by the GAT FASHION LAB design team containing the garment's size and color, flat sketch, silhouette, and process placement. Its approval is the milestone that authorizes the sample to enter development or manufacturing.
  • Process Sheet: A technical document containing the exact specifications of the garment's prints, embroidery, and other processes (measurements, position, colors, technique). It must be approved simultaneously with the Design Sheet.
  • Artwork: Graphic or vector design for processes applied to the garment: screen printing, sublimation, embroidery, DTF, high density, and/or any other required process.
  • Branding Artwork: Design of brand identification trims: woven labels, cardboard tags, hang tags. GAT FASHION LAB may design them (additional charge) and manage them through a third party, but does not manufacture them directly.
  • Branding Trims: Physical brand identification elements (woven labels, cardboard tags, hang tags, stickers, among others) that are incorporated into the garment. Their placement, quantity, and specifications must be approved as part of the Design Sheet (see Section 4.2); their graphic design and manufacturing are governed by Section 4.3 (Branding Artwork) and are not included in the sample quotation.
  • Garment Measurement Chart: Dimensional specifications of the garment by size. GAT FASHION LAB guarantees the garment's measurements in accordance with the approved chart, not the fit on the body of a specific model or end user of the client.
  • Model Measurement Chart: The measurements of the person who will try on the garment for validation; these are of the utmost importance, since garments are built based on these measurements. If they are not provided by the client and the client requests adjustments based on how the garments look, this will result in charges. If the client provides a measurement chart for the person who will try on the garments and later measures the garments on a different person, or these measurements change, GAT FASHION LAB shall not be held responsible, and the requested adjustments may result in charges.
  • Minor Adjustment: A modification that does not involve remaking the pattern, purchasing new materials, or manufacturing a new garment (seam correction, measurement adjustment within technical tolerance, replacement of a detail).
  • Major Adjustment: A modification involving a structural change to the garment, pattern redesign, silhouette change, incorporation of processes not quoted, or a change of raw materials already purchased.
  • Reference: Each garment design or style, treated as an independent development unit.
  • Correction and/or Adjustment: A modification requested on a sample or garment previously developed by GAT FASHION LAB for the same reference (as opposed to a new development from scratch). It may carry a differentiated rate relative to a full development, depending on the scope of the change (see Section 05).
  • Size Set: A set of physical samples of the same reference, made in sizes additional to the quoted base size, used to validate pattern grading across sizes. Quoted as an additional service, subject to availability and costs.
  • Garment Replicas: Reproduction, within GAT FASHION LAB's processes, of an existing garment (the client's or a third party's) provided as a physical reference, pattern, or tech pack, without any new design development involved. Quoted as an independent service.

03. What the Sample Service Includes (Tech Pack)

The quoted amount covers the following deliverables and activities for each approved reference:

3.2 Closing deliverables

As the closing of the development, GAT FASHION LAB delivers the physical sample and the Final Design Sheet, which consolidates: pattern files (PDS), printed patterns, and the quality test report for the reference.

3.3 Minor Adjustments

The maximum number of minor adjustments at no additional cost is 2, and in all cases:

  • The included adjustments are minor adjustments only (see Section 02). Major adjustments always incur an additional charge.
  • Adjustments to the physical sample that contradict the already approved Design Sheet will be treated as major adjustments.
  • Once the 2 included adjustments have been used, each additional adjustment is quoted and charged separately before being executed.

To reduce adjustments and optimize turnaround, GAT FASHION LAB recommends approving the Digital Sample before proceeding to the physical sample. This step is mandatory unless expressly agreed otherwise. Changes requested to the Design Sheet or the Digital Sample before their approval do not incur additional cost; once the Design Sheet is approved, the rules of this Section apply.

04. Development Process: Stages and Approvals

Sample development at GAT FASHION LAB follows a sequential workflow. Each stage is a prerequisite for the next. All approvals must be recorded in writing, understood as email, WhatsApp, or the platform designated by GAT FASHION LAB: all of these channels carry equal validity for the purposes of this policy. Approval must be express — for example, in response to a direct question from the GAT FASHION LAB team ("Do you approve the sheet / garment / test?"); silence authorizes GAT FASHION LAB to reschedule delivery dates, as set forth regarding response deadlines in Sections 08 and 12.

4.1 Selection and approval of fabrics or trims

The GAT FASHION LAB team proposes fabrics or trims based on its accumulated experience and the client's requirements. The process works as follows:

  1. GAT FASHION LAB proposes a maximum of two (2) fabric or trim options via photographs sent to the client. The client approves one option in writing. If the client requires more than two (2) fabric or trim options, they may expressly request them; this additional request incurs a charge that will be quoted in advance.
  1. If the client needs to physically validate the fabric or trim before approving it, they may request that a physical swatch be sent. The amount indicated in the table below corresponds to GAT FASHION LAB's sourcing and handling of the swatch; the cost of the fabric or trim swatch charged by the corresponding supplier is added to this amount. The cost is calculated per physical swatch requested, adding up according to the number of fabric or trim references the client wishes to validate. Shipping costs for physical swatches shall be borne entirely by the client.

  1. Once the fabric or trim is approved — by photo or by physical swatch — that choice is final for the reference. If the sample has already been sewn and the client does not like the approved fabric or trim, GAT FASHION LAB does not assume the cost of remaking it with a different fabric or trim; this must be paid again by the client.

Firm approval: Once the client approves the fabric or trim — by photo or by physical swatch — that choice is set for the reference. Minimal, unavoidable variations inherent to textile or trim processes (slight tone differences between lots, or in perception depending on lighting) between the photo/physical swatch and the finished garment are normal; these variations are not considered a breach by GAT FASHION LAB, provided the fabric or trim delivered corresponds to the one approved.

4.2 Selection and approval of branding trims

Branding trims (labels, tags, hang tags, stickers, and other brand identification elements) are approved as part of the process, independently of the graphic design of these elements (see Section 4.3 — Branding Artwork):

  • The client may supply the physical branding trims directly to GAT FASHION LAB, or request that GAT FASHION LAB manage their sourcing through a third-party supplier; in the latter case, design and manufacturing are quoted separately (see Section 4.3).
  • Regardless of who supplies them, the client must approve in writing, as part of the Design Sheet (Section 4.4): the exact placement of each trim on the garment, the quantity of units required per garment, and the trim's specifications (material, size, and artwork — see Section 4.3).
  • If GAT FASHION LAB manages sourcing through a third party, that third party's manufacturing lead times are independent of the sample's lead times (see Section 4.3).
  • Changes to the placement, quantity, or specification of the branding trims requested after the Design Sheet has been approved are handled in accordance with Section 4.4.

If the client supplies the branding trims directly and does not deliver them within the agreed schedule, the sample delivery date is rescheduled according to process availability at that time, with no liability for GAT FASHION LAB.

If the branding trims are not available at the time the sample is manufactured, GAT FASHION LAB may deliver the sample without the corresponding branding trims, without this affecting the agreed delivery times. If the client expressly requests that the sample include the branding trims, delivery times will be subject to the delivery times of those trims.

4.3 Graphic Design Processes: Process Artwork and Branding Artwork

By default, GAT FASHION LAB expects the client to supply their artwork in editable vector format. The graphic design service (creation or adjustment of artwork) is NOT included in the quoted sample amount: it is charged separately, according to the quotation for this service.

Process Artwork

Screen prints, sublimation, embroidery, DTF, high density, among others. Graphic design is NOT part of GAT FASHION LAB's sample process. If the client does not supply the artwork, GAT FASHION LAB creates it at an additional charge, per quotation.

Branding Artwork

Woven labels, cardboard tags, hang tags, stickers, etc. GAT FASHION LAB may design them and manages manufacturing through a third-party supplier. GAT FASHION LAB does NOT manufacture them directly. The third party's lead times are independent of the sample's, and design costs are quoted as needed.

THE CLIENT accepts and acknowledges that, as of this date, they are the owner and/or hold the rights to use the brand that will be reproduced by GAT FASHION LAB.

4.4 Comprehensive approval: the Design Sheet as the central milestone

The Design Sheet with all of its components — (a) flat sketch and silhouette of the garment; (b) size and colors; (c) placement, size, and specifications of the applied processes (Process Sheet); (d) approved fabrics, trims, and colors (Fabric, Trim, and Color Approval Document); (e) the applicable Measurement Chart; and (f) placement and artwork of the approved branding trims (see Section 4.2) — approved as a whole, is the document that authorizes the garment to enter the development process. At the moment of approving it, the client must simultaneously approve:

  • Silhouette and general construction (oversize, regular, slim, etc.).
  • Placement, size, and specifications of the processes (Process Sheet).
  • Fabric and trim colors available in inventory for the sample and production.
  • Measurement chart: GAT FASHION LAB standard or customized (see Section 4.5).
  • Placement, materials, and information of the branding trims (labels, tags, hang tags, stickers), and whether they are supplied by the client or managed by GAT FASHION LAB (see Section 4.2).

Once the Design Sheet (and all of the above elements) has been approved, no free changes to the garment in development are permitted. Any subsequent modification constitutes a Major Adjustment or a new reference and incurs an additional charge, which must be quoted and paid before being executed.

No-charge exception: If GAT FASHION LAB makes an execution error with respect to what was approved in the Design Sheet (for example: the client approved "regular fit" and the team sewed "oversize"), the correction is made at GAT FASHION LAB's expense, at no charge to the client.

4.5 Measurement Chart

The applicable measurement chart is defined at the time the Design Sheet is approved: regardless of whether the client opts for the standard chart or for customized measurements, GAT FASHION LAB will always request the measurements of the fitting person or model (Model Measurement Chart) in order to recommend the most suitable size within the GAT FASHION LAB standard.

  • GAT FASHION LAB standard chart: The client accepts GAT FASHION LAB's standard chart for each garment type, which will be sent for their approval. This is the default option in all developments.
  • Customized chart: The client supplies their own measurements. GAT FASHION LAB will send a form or tutorial so they can record them correctly before the approval session.
  • Model Measurement Chart: The client supplies the measurements of the person or model on whom the initial sample will be tried. With this data, GAT FASHION LAB verifies that the garment's measurement chart corresponds to the model's measurements, so that the garment meets the client's requirements. If the client does not supply this information, GAT FASHION LAB shall not be responsible for differences between the garment and the model. If the client supplies the Model Measurement Chart and it changes, or the sample is tried on a person other than the one reported, GAT FASHION LAB shall likewise not be responsible for the resulting differences between the garment and the model.

GAT FASHION LAB guarantees that the garment meets the measurements of the approved chart. It does not guarantee the fit on the body of the client's model or end users. If the garment meets the chart and the client is not satisfied with the fit, changes carry an additional cost.

Best practice: Regardless of whether the client pays for a customized measurement chart, GAT FASHION LAB will always request from the client the size and measurements of the fitting model or person before sewing the sample. This aligns expectations from the start and reduces unnecessary adjustments.

4.6 Process tests

Before sewing, the technical team performs and internally fine-tunes the process tests (prints, embroidery, etc.) until achieving the result most faithful to the approved Process Sheet.

  • GAT FASHION LAB sends photos of the tests to the client through the official communication channels before sewing. The client must approve them in writing.
  • Prior internal approval: before sending the test photos to the client, GAT FASHION LAB's graphic design and processes lead internally validates that the test complies with the approved Process Sheet (technique, size, color, and placement). Only tests that pass this internal validation are sent to the client for approval.
  • The client must approve or reject the process tests within five (5) business days of receipt, under the same general terms of Section 12 (Client Responsibilities).
  • Physical shipment of process samples to the client (embroidery samples, print swatches) occurs only in justified cases agreed upon in advance. The shipping cost is always borne by the client.
  • GAT FASHION LAB performs up to two (2) rounds of process testing (screen printing, embroidery, sublimation, DTF, high density, etc.) per Process Sheet, at no additional cost, provided the adjustment falls within what has already been specified and approved in the Sheet. Changes in technique, size, color, or placement not previously approved do not count toward this limit: they are treated as a change exceeding what was approved. Once the 2 included rounds have been used, each additional test is quoted and charged separately before being executed, following the same logic as the minor adjustments in Section 3.3.

4.7 Fitting

With fabrics, trims, and processes approved, GAT FASHION LAB proceeds to manufacture the sample. Once sewn:

  1. Standardized photographs are taken (front, back, profile, and relevant details). The fitting process is photographic.
  2. GAT FASHION LAB sends the fitting photos to the client together with the measurement report, to verify compliance with the approved chart and validate dispatch of the sample.
  3. The client approves the fitting in writing or requests minor adjustments within the rounds included in the quotation.

Measurement guarantee: If the garment meets the approved chart and the client wants changes based on aesthetic perception or on the fit on their own model, such changes incur an additional charge.

4.8 Final approval and dispatch

Once the client approves the sample, the development process is closed. From that moment on:

  • Any change to the approved garment is considered a Major Adjustment or a new reference and incurs an additional charge.
  • Approval of the sample is an essential prerequisite for starting volume production. GAT FASHION LAB will not produce without this formal approval.
  • In addition to approving the sample, the client must confirm the Production Order in writing (quantities, sizes, colors, price, and delivery date) before GAT FASHION LAB begins the sourcing and purchasing process for production. Approval of the sample enables this process to begin, but does not replace it.
  • All costs of shipping the sample to the client (domestic or international) are borne by the client.

Notice: If the client formally approves a sample and later requests changes in production alleging non-compliance with requirements previously approved by the client themselves, GAT FASHION LAB will not assume responsibility for the costs arising from that contradiction, except in the case of an error attributable exclusively to GAT FASHION LAB.

05. Changes After Sample Delivery

If the client receives the sample and it complies with the approved Design Sheet, Process Sheet, measurement chart, and colors, but still wants changes, the following distinction applies:

The decision as to whether a change applies to production at no cost or requires a new sample with a charge is made by GAT FASHION LAB's technical team based on quality and production feasibility criteria, and will be communicated to the client in writing. The client may request additional samples, corrections, or adjustments even when the technical team considers the change applicable directly in production without a new sample. Correction or adjustment samples on a development already carried out by GAT FASHION LAB may carry a differentiated rate relative to a new development. GAT FASHION LAB also offers, as additional services, the Size Set and samples for photography or content (see Section 02).

Corrections and adjustments must be reported in the format stipulated by GAT FASHION LAB; adjustments submitted through other means will not be accepted.

06. Major Adjustments and New References

6.1 Major Adjustments — incur an additional charge

GAT FASHION LAB will communicate the additional cost in writing; it will not proceed without prior approval and payment:

  • Silhouette change or structural redesign after pattern making has begun.
  • Change of the main fabric type or trims after they have been purchased.
  • Incorporation of processes not quoted (embroidery, sublimation, screen prints, etc.).
  • Request for additional physical samples beyond the one included in the quotation.
  • Change of measurement chart requiring the full pattern to be remade or the sample to be repeated.
  • Modifications after approval of the Design Sheet.
  • Change of the fabric color or modification of trims after the materials have already been purchased or the sample has already been manufactured.
  • Replication of the same style in another size range (e.g., adult to child).

6.2 New References — require a new quotation and payment

  • A design different from the one originally quoted, even if similar in construction.
  • A complementary garment or accessory not included in the original quotation.

07. Other Circumstances Involving Additional Charges

08. Delivery Times and Deadlines

8.1 Standard process times

8.2 Conditions affecting times

  • Times run from when GAT FASHION LAB receives all required information and confirmed payment.
  • Client silence for more than five (5) business days authorizes GAT FASHION LAB to reschedule the project's delivery dates: the days of delay in responding are added to the schedule, with no liability for GAT FASHION LAB, and the new date is set according to the availability of processes and raw materials at that time.
  • The availability of raw materials and process suppliers may extend the times. GAT FASHION LAB will give advance notice.
  • For imported fabrics and trims, customs and transportation times are added to the standard times.
  • Force Majeure events release GAT FASHION LAB from liability, provided the client is notified in a timely manner.

09. Crediting the Sample Value Toward Production

The client may credit toward production a percentage of the amounts paid for the sample development service, provided the following conditions are met:

  • The amount the client may credit toward production is the gross amount (excluding taxes, logistics, and any other charges) paid for the development of the sample for that reference.
  • The credit only takes effect if the production order for the SAME reference reaches the minimum amount indicated in the table in this Section, measured on the gross value of the production order (that is, excluding taxes, logistics, and any charge additional to the production itself). The percentage of credit or reimbursement on what was paid for the sample depends on the gross-value RANGE into which that production order falls: the higher the order, the higher the credit percentage. If the production order does not reach the minimum range in the table, the sample generates no credit or reimbursement.

  • The credit is assessed reference by reference: developments of several different references cannot be combined to reach a higher discount tier.
  • The credit applies only to the first production order for the reference placed with GAT FASHION LAB.
  • It applies only when production is carried out with GAT FASHION LAB. References that are not produced do not generate or accumulate discounts for other references that are produced by GAT FASHION LAB.
  • It is calculated on the gross value of the sample (excluding VAT, logistics costs, and any other charges), not on the total invoiced amount.
  • It cannot be combined with other promotions or special agreements, unless expressly agreed in writing.
  • The production order must be formalized within two (2) months of the approval of the physical sample. After this period, the discount does not apply.
  • It is applied as a credit note or discount on the production invoice, not as a cash refund.
  • Only the amounts paid for the development of the first sample of the reference are credited. Amounts paid for corrections and adjustments, Size Sets, or counter-samples requested by the client are non-refundable and do not qualify for this discount.

10. Returns and Refunds Policy

All refund amounts are calculated on the gross value of the sample service (excluding VAT). Taxes paid are not subject to refund by GAT FASHION LAB; it is the client's responsibility to manage them before DIAN (the Colombian tax authority) in accordance with applicable tax regulations.

10.1 Cases in which a refund or credit applies

10.2 Cases in which refunds do NOT apply

  • The client changes their mind about the design after GAT FASHION LAB has started the process, with no error attributable to GAT FASHION LAB.
  • The client does not supply the required information within the deadlines, resulting in effective abandonment of the project.
  • The client approves the Design Sheet and the sample complies with it, but the client decides not to proceed with production.
  • The approved fabric or trims (by photo or physical swatch) arrive in the sample and the client does not like them, with no objective difference between what was approved and what was received.
  • Subjective differences of aesthetic taste that do not constitute a technical breach of the approved specifications.

10.3 Procedure for requesting a refund or credit

  1. The client sends a written request to info@gat.com.co within the 15 business days following the event giving rise to the claim.
  2. The request must include: invoice number, reference(s) involved, detailed reason, graphic or documentary evidence, and the chosen option (credit or refund) where applicable.
  3. The GAT FASHION LAB team reviews the request within a maximum of 15 business days and issues a formal response.
  4. If a refund applies, the reimbursement is made within a maximum of 30 business days, or within the time defined for these procedures by the financial institutions. The reimbursement will be issued through the same payment method by which the money was received. Credit toward production is recorded immediately.

11. Intellectual Property and Confidentiality

Once full payment for the service has been completed, GAT FASHION LAB transfers to the client ownership of the pattern files (digital patterns) developed specifically for their project. Internal processes, methodologies, know-how, pattern libraries, and software owned by GAT FASHION LAB are not included.

GAT FASHION LAB keeps in strict confidentiality the designs, concepts, and specifications shared by the client.

THE CLIENT authorizes GAT FASHION LAB to use the samples, together with their photographic record, for portfolio or marketing purposes, under the same confidentiality terms as the preceding paragraph.

The client warrants that the designs supplied do not infringe third-party rights and assumes full responsibility for any intellectual property claim arising from the artwork provided by the client.

12. Client Responsibilities

  • Supply complete, clear, and timely information: tech packs, designs, artwork, measurement chart, reference images, size and measurements of the fitting model, and any relevant specification before the process begins.
  • Review and approve (or reject with specific comments) each deliverable within the 5 business days following its receipt. Silence for more than five (5) business days authorizes GAT FASHION LAB to reschedule delivery dates; that delay time is nonetheless added to the project's overall schedule in accordance with Section 08.
  • Communicate changes precisely and in documented form through GAT FASHION LAB's official channels.
  • Make payments within the agreed deadlines. GAT FASHION LAB reserves the right to suspend the process in the event of non-payment.
  • Bear all shipping costs: raw material swatches (fabric and trims), process tests, and the physical sample.

13. Final Provisions

GAT FASHION LAB reserves the right to update this policy. Changes will be announced at least fifteen (15) days in advance by publication at www.gat.com.co. Contracts in force at the time of the change will be governed by the version applicable on their signing date.

This policy is governed by the laws of the Republic of Colombia. Any dispute shall be submitted to the dispute resolution mechanisms set forth in GAT FASHION LAB's general Terms and Conditions.
